In messages conveyed to the victim following the assault, Guy Mukendi, aged 39, attempted to justify his actions by mentioning his prolonged abstinence from sexual activity, before erasing the incriminating evidence.
A man has been sentenced to a four-year and three-month jail term for rape for surreptitiously removing a condom during sexual intercourse without the woman’s knowledge.
Guy Mukendi, a 39-year-old man from Brixton, south London, has been sentenced at Inner London Crown Court after being convicted on 2 April. Following a report by a young woman in Brixton on 9 May last year, it was revealed that she had agreed to have sexual intercourse with Mukendi on the condition that he used a condom. However, he removed the condom without her knowledge during the act.
The Metropolitan Police provided support to the victim during this challenging period after she reported the incident. Working closely with the victim, the police were able to obtain screenshots of messages sent by Mukendi, where he apologized for his actions and attributed them to a long period of sexual inactivity.
Although Mukendi deleted the messages afterwards, the screenshots played a crucial role in securing his conviction. Prosecutions for non-consensual condom removal, considered as rape under English and Welsh law, are infrequent due to lack of reporting according to the police.
Detective Constable Jack Earl, the leader of the investigation, stated, “During the investigation, Mukendi consistently denied any culpability, but our team of officers meticulously constructed a convincing case to eliminate any uncertainty in the jury’s judgment. Our commitment was to ensure justice for the victim and to increase awareness that this act constitutes a form of rape. The victim took the essential step of promptly reporting to the authorities, and her courage should be commended without reservation.”
